East Brandywine Homeowners Win $3.25 Million Suit Against Homebuilder

Three pairs of homeowners in East Brandywine Township were awarded $3.25 million by a jury in a lawsuit against builder Southdown Homes.

Three pairs of homeowners in East Brandywine Township have been awarded a total of $3.25 million by a Chester County jury in a lawsuit against builder Southdown Homes over defects, writes Michaelle Bond for The Philadelphia Inquirer

The families purchased homes in Estates at Hideaway Farms, a single-family development built by the Chester County homebuilder, with prices ranging from $600,000 to $800,000.

Homeowners claimed that improperly installed stucco and windows caused water infiltration that damaged their homes.

The lawsuit accused the builder of negligence, misrepresentation, breach of contract, and violations of consumer protection laws. 

The three families are part of a group of more than 20 Hideaway Farms residents that have pending lawsuits awaiting trial. The first case received a verdict on June 5, ruling in favor of the plaintiffs on all claims. 

“I believe that the verdict accurately and fairly reflected the evidence presented,” said Jennifer M. Horn, founding partner at Horn Williamson, the law firm representing the homeowners. 

In court, Southdown Homes claimed homeowners failed to mitigate damages and that alleged damages “were the result of an Act of God.”
