Ohio-based brewery Urban Artifact filed a federal lawsuit earlier this month against Pennsylvania claiming that their business is hindered by favoritism for in-state brewers, writes Michael Tanenbaum for the Philly Voice.
The 9-year-old Cincinnati brewery, which specializes in fruit-infused beers, says that the Keystone State has unfair barriers that restrict sales from out-of-state companies.
Pennsylvania breweries can sell and ship their beer to consumers without needing additional licensing or having limits on quantity and volume.
Meanwhile, companies that are selling their products to Pennsylvania consumers across state lines need to obtain a direct beer shipping license from the Pennsylvania Liquor Control Board as well as a retail or wholesale license from their home states.
Out-of-state breweries also have a 90-ounce per month limit per customer, even with all the licenses.
