Former employee of Stowe-based concrete firm sentenced in federal court

United States Attorney William M. McSwain announced that Scott Capps, 48, of Coatesville, Pennsylvania was sentenced to 48 months’ incarceration, three years’ supervised release, restitution of $2,137,580 and forfeiture of $648,600 by United States District Judge Michael M. Baylson for a fraud scheme perpetrated while he was an employee of Vanguard.

Andrew Nolan, who pleaded guilty to conspiracy to commit wire fraud and admitted to lying about quality control data for concrete used in the Virginia Metrorail project, was sentenced in federal county to one year and one day in prison.

Andrew Nolan, 28, now a Florida resident, worked for his family’s company Universal Concrete, a Stowe -based subcontractor on the project, in its quality control department until quitting in June 2016. He admitted to directing employees to falsify information about air content in the project’s pre-cast concrete, writes Michelle Caffrey in the Philadelphia Business Journal.

Nolan had been described by Universal Concrete in court filings as a rogue employee who confessed to falsifying documents and that the company was unaware that the concrete did not meet the specifications.

Universal provided concrete panels at local projects including Citizens Bank Park and Drexel University. Both organizations told the Business Journal in August it investigated the situation and determined there were no issues with concrete used in their projects.
