A Jenkintown Tomato Company Is Being Sued Over ‘Highly Misleading Tomato Packaging’

The claimant Andrea Valiente of California said that the company is trying to pass off “inferior” Roma tomatoes for San Marzano tomatoes.

A woman is alleging that Simpson Imports Ltd., based in Jenkintown has used “highly misleading tomato packaging” on its canned and boxed San Merican Tomatoes, writes Ryan Genova for Glenside Local.

The lawsuit will proceed in federal court despite attempts from Simpson to have the case dismissed.

The claimant Andrea Valiente of California said that the company is trying to pass off “inferior” Roma tomatoes for San Marzano tomatoes.

She is seeking compensatory, statutory, and punitive damages as well as other forms of monetary relief.

In a statement, Simpson Imports has denied any wrongdoing.

“Simpson Imports strongly disputes that reasonable consumers could have been deceived by Simpson Imports’ labels into thinking they were purchasing San Marzano tomatoes. Given the very high quality of the tomato products that Simpson Import sells and the complete absence of any reference to ‘San Marzano’ on the label, it is hard to find any legitimate basis for Plaintiff’s claim,” the company said.
