No End in Sight on Litigation Surrounding St. Charles Borromeo Seminary Campus

Last week’s decision by a federal judge to deny summary judgment in the St. Charles Borromeo Seminary campus case may postpone the Archdiocese of Philadelphia’s plan to sell the property, writes Harold Brubaker for Philly.com.

The fight over the Lower Merion Township property is between Main Line Health and New Jersey developer William Burris. Burris claims that Main Line Health cut him out of a joint deal to develop on the property. However, if a pre-trial settlement is reached, the archdiocese may still be able to complete the sale.

The key issue is whether there was actually a partnership agreement in place between Main Line Health and Burris. After considering the arguments, U.S. District Judge Gene E.K. Pratter ruled that there was enough evidence for a trial.

“While email exchanges between Main Line executives, and Main Line’s shifting position vis-à-vis Mr. Burris may raise doubts about whether a Burris-Main Line partnership existed,” wrote Pratter in a 29-page ruling, “those inconsistencies or shifts are ultimately for a jury, not the court, to evaluate.”
