Fox 29 Anchor From Lower Merion Keeping Score in Facebook Court Fight

The Lower Merion-based Fox 29 anchor is continuing her fight against Zuckerberg and Facebook over advertisements over dating sites that used her image without permission. Investigators at Fox’s New York City corporate office uncovered that the anchor’s image was used in other advertisements like an ad for erectile dysfunction treatment and on various NSFW sites.
She then sued the company over her photo in an ad for a dating site, without her permission, or even knowing about it.
In September 2019, Hepp filed her case with Philadelphia’s federal court, and a judge dismissed the claim in 2020. Facebook had argued that “the company was immune from any liability, due to United States law Section 230,” reports the magazine.
Samuel Fineman, Hepp’s lawyer appealed the case, leading to a ruling that the judge in Philadelphia shouldn’t have dismissed her case. Facebook did not like that, so they asked the appeals court to reevaluate.
In March 2022, Facebook then filed a motion to dismiss, and the Karen Hepp case is now back in Philadelphia federal court and has moved “to the discovery phase.”
