Lower Merion Fox 29 Anchor Gets Good News from Appeals Court Regarding Her Legal Battle with Facebook

Fox 29 anchor Karen Hepp, a Lower Merion resident, has received some good news from a federal appeals court in her ongoing legal battle with Facebook, writes Victor Fiorillo for the Philadelphia Magazine.

Hepp filed a $10 million lawsuit against the social media giant in September 2019 over the unauthorized use of her photo in an ad for a dating site that appeared on Facebook.

The company argued that Section 230 of the Communications Decency Act protected it from liability.

The controversial and what some consider to be a very outdated measure basically protects companies such as Facebook when a post or a comment made by a user on the platform ends up being problematic.

Federal judge John Milton Younge in Philadelphia agreed with Facebook and tossed the case.

However, Hepp appealed the decision based on the legal principle known as “right of publicity” and the appeals court sided with her.

This means that her lawsuit can now proceed to the next step unless Facebook’s lawyers find another way to block it.

“We’re very happy,” said Hepp’s attorney Samuel Fineman.
