Federal Court Lawsuit Against Valley Forge Military Academy Foundation Dismissed

Valley Forge Military Academy Foundation (VFMAF) has announced that the federal court lawsuit brought by supporters of a former VFMAF president has been dismissed, clearing the Foundation and its Trustees of any wrongdoing.

“We are thankful for this conclusive action by the courts, so we can move past this frivolous lawsuit,” said John English, Chairman of the Board of Trustees. “It took time to work through the court system, but the facts, or more accurately, the absence of any facts, ultimately prevailed.”

The suit claimed VFMAF breached its contract with cadets by not reinstating former president, retired M.G. Walter Lord, after his resignation. The legal action was originally filed by Derek Graham and Scott Newell on April 1, 2019.

A Nov. 27, 2019 ruling found insufficient evidence but allotted extended time for the plaintiffs to refile a substantiated complaint. That time has since expired.

“Changes in leadership happen,” said English. “It is unfortunate that we couldn’t come to a resolution with Major General Lord, but we accepted his resignation in good conscience and are looking forward to getting back to our top priority — forming young men and women into the leaders of tomorrow.

“We’re glad to be moving into a new year with one less unnecessary distraction.”
